North Queensland Fury FC - 20010/11 Membership Terms
These terms form a legally binding contract (Agreement) between the member (you) and North Queensland Fury Football Club (operating as North Queensland Fury FC) (Club). By ordering a membership of the Club and receiving the Membership Benefits, you agree to the terms of this Agreement.
Membership Terms
1. 2010/11 North Queensland Fury Members entitlements commence on the first home match played by North Queensland Fury in the 2010/11 Hyundai A-League regular season and expire 31 March 2010 (Term). You will receive a first right of refusal to renew your membership for the 2011/12 season.
2. Seat allocations are subject to availability and will be determined at the time of purchase.
3. Membership entitles you to entry to 15 home matches played by the North Queensland Fury, including all home matches in the 2010/11 Hyundai A-League draw. Matches played by North Queensland Fury in excess of the 15 matches that are included in your 2010/11 Membership, are additional and will be available to purchase on standard terms and conditions. Notwithstanding any other clause of this Agreement, Foundation Membership does not include entry to any home matches played by North Queensland Fury as part of the 2010/11 Hyundai A-League pre-season or finals series (including play-offs, semi-finals, preliminary finals and the grand final), or any other match or competition under the control of auspices of Fédération Internationals de Football Association (FIFA), the Asian Football Conference (AFC), including the Asian Champions League, or any other national association.
4. All prices included in the membership brochure are inclusive of GST.
5. Membership does not entitle you to entry into A-League Finals Series fixtures; however, you will have priority booking rights for such fixtures, subject to availability. The Club is unable to guarantee the same seats you have during the season.
6. Child memberships (and the child component of family memberships) apply to persons between the age of 5 and 15 as 31 July 2010. Children 4 and under are free if they do not require a seat. If they do require a seat a Child membership must be purchased. Family memberships comprise of 2 adult and 2 child memberships or 1 adult and 3 child memberships. Proof of eligibility for child memberships MUST be available for display at entry into the ground, at point of sale and point of collection.
7. Concession memberships apply to Senior Card holders, Disabled Card holders, Veteran’s Affair Card holders, tertiary students with valid Student ID. Proof of eligibility for concession memberships MUST be available for display on entry into the ground, at point of sale and point of collection.
8. You must comply with the Spectator Code of Behaviour (available on www.footballaustralia.com.au), Venue Conditions of Entry and Club Terms of Admission. If you do not comply with these requirements, you may be evicted from the venue or banned from attending future matches and you will be subject to legal action.
9. Members wishing to sit within organised supporter group areas must be seated in a reserved seat not general admission.
10. Dishonest credit card payments: if a credit card payment is declined by your bank, you will be contacted regarding an alternative form of payment. If the further payment option if not successful, you order will be removed from the seating allocation queue.
11. All Members must take responsibility for updating all personal details so the North Queensland Fury FC can communicate effectively with them. North Queensland Fury FC holds no responsibility for member’s failure to update their personal details.
Ticket Conditions
12. In respect of all Tickets you receive as part of your membership, you must comply and must ensure that each subsequent holder of any of your Tickets complies with: (a) this Agreement; (b) the ticketing conditions as set out on the back of the Tickets; and (c) the rules and regulations of Dairy Farmers Stadium, including terms of entry and any restricted or prohibited items.
13. You agree with the Club: (a) not to resell or transfer the Ticket at a premium; (b) not to use Tickets for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services; and (c) not to bundle Tickets with other goods or services, without the Club’s prior written consent. If this condition is breached, the Club may, in addition to any other remedy and even if the holder of the Ticket did not have notice of the condition or the breach, deny the holder admission to any Match or Matches and retain the price of the Ticket.
Limitation of liability
14. Nothing in this clause affects your rights under the Trade Practices Act 1974 or similar legislation under which the Club’s liability may not be excluded, restricted or modified by private agreement (TPA Rights).
15. If the Club is liable to you for any: (a) breach by the Club of any express term of this Agreement; (b) breach by the Club of any term implied into this Agreement under the general law; or (c) any tort committed by the Club (including negligence but not including fraud), the Club’s liability to you is limited (at the Club’s election) to the Club repaying any amounts paid by you under this Agreement or supplying or resupplying any Tickets to which you are entitled in accordance with the terms of this Agreement.
Cancellation, Refunds and Replacements
16. Once your membership application is submitted to the Club you cannot cancel your membership and, without limiting clause 19 & 20, refunds and exchanges are allowed only as expressed in this Agreement.
17. The Club's use of Dairy Farmers Stadium is subject to the terms of venue agreement between the Club and Dairy Farmers Stadium. The Club's A-League regular season home games have been scheduled to minimise the prospect of Matches being cancelled, however you acknowledge that all Matches are subject to cancellation or rescheduling to another date, at any time and for any reason.
18. Notwithstanding any other provision of this Agreement, if a Match is cancelled and cannot be rescheduled, the Club will refund the Discounted Value of the Ticket. If a Match is cancelled and rescheduled to a venue outside of Townsville, the Club will refund the Discounted Value of the Ticket or (if you elect) exchange your Ticket for a ticket of the same or lower face value to the rescheduled Match. Any refund or exchange entitlement must be applied for in accordance with instructions and time frames issued by the Club and/or its ticketing agent from time to time.
19. Subject to your Consumer Rights, you cannot obtain a refund or exchange your Ticket if: (a) the date or time of, or teams participating in, a Match changes after the date you purchased your Ticket; (b) the Match is rescheduled to another venue in Townsville; or (c) after a Match has started it is cancelled for any reason.
20. You will bear the prevailing replacement fee(s) for the replacement of a lost, stolen or damaged Ticket.
20. Except for liability that by law cannot be excluded:
the club is not liable to you for any loss or damage you suffer as a result of the Hyundai A-League or any Match being cancelled, postponed or changed; and
the Club disclaims the existence of any common law duty of care to you and any holder of the ticket
21. The Club will not replace your Ticket, if lost, stolen, forgotten, damaged, forged or unreadable. You will bear the prevailing replacement fee(s) for the replacement of a lost, stolen or damaged ticket.
22. The Club reserved the right to cancel a membership at any time if, in the opinion of the Club, a member engaged in Disruptive Behaviour.
Privacy Statement
23. The Club respects the privacy of the individuals on whom the Club collects, uses and discloses personal information. Any personal information provided by a Member is stored securely and held by the Club and ticketing agent, Ticketek, and is handled in accordance with the FFA’s Privacy Policy (a full copy of which is available at www.footballaustralia.com.au)
24. The personal information that the Club collects about you is used for the purpose of processing your membership and providing you with football related information from the Club and FFA. Unless you elect otherwise, you agree to the disclosure of personal information about your membership to the Club's sponsors, FFA and FFA's sponsors and that you may be contacted by such persons during the life of the membership with special offers and promotional information about their services and products.
25. You may access any personal information held by the Club about you, and correct any information that may be incorrect. You may direct any questions or concerns about how the Club may collect, use or store your personal information to info@nqfury.com.au.
General
26. The Club may choose not to enforce a term of this Agreement in some cases in its absolute discretion without affecting its right to enforce that term in other cases, including by replacing Tickets if you can demonstrate proof or purchase and identity acceptable to the Club.
27. All dates, times, participating teams and venues of Matches are as specified on the www.footballaustralia.com.au from time to time and may change without notice to you.
28. This Agreement: (a) is governed by the law applicable in Queensland and each party submits to the jurisdiction of the Queensland Courts; and (b) is the entire agreement between Club and you in respect of its subject matter (subject to clause 8) and supersedes any prior agreement, representation or promotional material.
Definitions
In this Agreement:
Discounted Value means the price paid for the membership divided by 15 and excluding booking and transaction fees.
FFA means Football Federation Australia Limited, which is the national governing body of Football in Australia.
Hyundai A-League means the national club competition staged by FFA known as the Hyundai A-League (or a name as otherwise notified by FFA).
Match means a match in the Hyundai A-League in which North Queensland Fury FC participates in at the date, time and venue and against the opposing team as specified on www.footballaustralia.com.au from time to time, does not include entry to any home matches played by North Queensland Fury as part of the 2010/11 Hyundai A-League pre-season or finals series (including play-offs, semi-finals, preliminary finals and the grand final), or any other match or competition under the control of auspices of Fédération Internationals de Football Association (FIFA), the Asian Football Conference (AFC), including the Asian Champions League, or any other national association.
